Copyright Release Form – A photo release form allows an individual or photographer to obtain permission from another party to use their personal or commercial photos. The releasing party, the “licensor”, may choose to grant the rights to the images for free or to pay a fee or fees. In the case of payment, ownership rights in the images do not expire until payment is made and the release form is approved.

A photo release form is a legally binding document that gives a photographer, business entity or individual (“releaser”) permission to obtain photographs for personal or commercial use. The model or named person (“Releasor”) provides permission, may request payment, payment, or may provide rights for future use, free of charge.

A photo release form is required when an identifiable image of an individual is to be used in a commercial endeavor. The age of majority is defined by each state and local laws should be referred to or legal advice sought. An emancipated child will not require an additional signature from a parent or guardian.

(1) Release. The owner of the image discussed in this version will (usually) be the model, the photographer, or both. This form requests a release of image rights for one person, but it can be modified for one party to grant this release. Make sure that any party that intends to release their rights to the image is listed as a “releaser” of the media. Each named person will be required to sign this notice to enforce it.

(2) Mailing address. Record the postal address where each issuer mentioned above can be (legally) contacted. This can be the business address or home address of the issuer. It is not recommended to use an email address unless necessary.

(3) released. The party or entity wishing to obtain the right to use, display or publish the image must be identified as a releaser in this agreement. If it’s a business entity such as a PR firm, include the applicable state suffix if applicable (ie “Corp.,” “Inc.,” “LLP.”).

(4) Image to be published. Naturally, the image in question must be explained. (5) Payment. Often times, payment will be required from the breeder to the breeder before they are given the right to access and use the image. In such a case, this release must reflect such payment. To do this, check the appropriate check box in the first report in section I. This report will only work if the documents for the payment are produced in the designated area.

(6) No payment is required. If the exemptee will not require payment, check the second check box among the options shown in section I.

(7) Royalty Fee. Whether or not they require a release fee, some images may ensure that a payment is made to the releaser each time the image is displayed or used by the releaser. Such payment must be disclosed in this release. To do this, review the options in Part II, select the appropriate statement, and then release the royalty payment amount that the Releaser must submit to the Releaser every time the photo is displayed or used.

(8) No royalty payments. If the release will not be forced to pay a fee for displaying or using the image in question, select the second statement in Part II.

(9) No cancellation is permitted. If this release will be considered final when executed and there will be no option for the issuer to withdraw or revoke it, check the first check box in point three.

(10) Possibility of cancellation. Select the second statement in Section III if the issuer intends to retain the right to cancel or terminate this document in the future. This will allow the issuer to renegotiate the release terms or delay the release of the image if necessary in the future for any specified reason as long as such cancellation is made in writing.

(11) Declarant’s signature and printed name. This document will only be valid if the issuer checks the completed document and signs his name. This signature will be considered as proof that the intention to release the image from the releaser is genuine.

(12)  Signature of date of issue. The issuer must date the document he signed. This date should be the date on which the issuer provides the required signature.

(13) Releaser’s signature and printed name. The party or institution wishing to use or display the image in question must sign this page. If it is a business entity (ie a marketing agency), then a representative (ie an agent or officer) of that entity can sign this page to accept the terms of the release.

(14)  Date of release signed. The signed signature must be dated. He must release on that calendar date as soon as the release’s signature clause is executed.
